Uniondale, December 18, 2009 — Managing Partner Jeffrey D. Forchelli is featured in the Long Island Business News’ listing of "Who's Who in Commercial & Residential Real Estate Law."

In the article, Mr. Forchelli comments on important questions to ask when purchasing property. He cited finding out what use or uses are currently permitted for the property, and if those uses consistent with the proposed use or uses contemplated by the purchaser.

“In the case of a purchaser buying a single-family house for use as a single-family house, the question can be answered simply by the seller providing a Certificate of Occupancy for all existing structures of the property,” Forchelli said. When the property is purchased to enlarge existing structures … then the question becomes more difficult. He noted, “The purchaser’s attorney is then required to do an analysis of the existing zoning, the existing uses, the proposed use or uses. Once that analysis is completed, including the likelihood of success, it must be discussed with the purchaser because the likelihood of success or lack of success will weigh heavily on the value of the property and, consequently, the purchase price that can be paid.”
